Frequently Asked Questions about Medical Marijuana

To be considered a seasonal resident of Florida, you must:

  • Reside in Florida for at least 31 consecutive days during each calendar year
  • Maintain a temporary residence in Florida
  • Return to the state of your permanent residence at least once during each calendar year
  • Pay income tax or be registered to vote in another state

If you meet all of the above criteria, you may be considered a seasonal resident of Florida. Proving seasonal residency is a necessary step in getting your Florida medical marijuana card. Before being approved for a medical marijuana card, you must have all the documentation required  with you or pictures in your phone at your appointment to prove you are a seasonal resident. 

 

Seasonal Florida residents who do not possess a valid Florida driver license or Florida identification card must submit a copy of two of the following documents (PLEASE HAVE THIS WITH YOU AT YOUR APPOINTMENT OR PICTURES IN YOUR PHONE):

  • A deed, mortgage, monthly mortgage statement, mortgage payment booklet or residential rental or lease agreement.
  • One proof of residential address from the seasonal resident’s parent, step-parent, legal guardian or other person with whom the seasonal resident resides and a statement from the person with whom the seasonal resident resides stating that the seasonal resident does reside with him or her.
  • A utility hookup or work order dated within 60 days before registration in the medical use registry.
  • A utility bill, not more than 2 months old.
  • Mail from a financial institution, including checking, savings, or investment account statements, not more than 2 months old.
  • Mail from a federal, state, county, or municipal government agency, not more than 2 months old.

Please bring:

  • Your FL Driver’s license or State-issued ID card. If you are a qualified Seasonal Resident, please see the question directly above.
  • A smart cell phone or tablet so you can receive email to complete the ID card application.
  • Be able to pay $77 to the Florida Department of Health. This can be made online. If you a mail a check with a your completed paper application, this will delay your ability to buy medical cannabis until the state receives and processes your payment.
  • Medical records from an outside physician indicating your diagnosis are helpful, if available. 


  

The current list in the state of Florida includes:

  • Cancer
  • Crohn’s Disease
  • Epilepsy
  • Glaucoma
  • HIV/AIDS
  • Seizure Disorders
  • Multiple Sclerosis (MS)
  • Parkinson’s Disease
  • Post-Traumatic Stress Disorder (PTSD)
  • Amyotrophic Lateral Sclerosis (ALS)
  • Non-malignant Chronic Pain (pain that is not from Cancer)
  • Also, other medical and/or behavioral conditions of like kind or class, with similar symptoms as the conditions listed above, may be eligible for a medical marijuana certification.


MMJ patients are authorized to designate a "caregiver" to assist them with the purchase and/or administration of medical marijuana products. 

The patient's qualified physician is the only person able to add a caregiver to a patient's profile in the Medical Marijuana Use Registry. Click here for more information.


Yes, we see patients by appointment only, so either schedule an appointment online, call our office at 352-897-2240 or email us to schedule an appointment.


Our office does not have any medical cannabis marijuana / products on site or available. After it is determined that you have a qualifying medical condition, complete the required registration and payment to the state, you will be able to visit dispensaries in our area to purchase cannabis products.


We accept all major credit cards, debit cards, Venmo, and PayPal.
No checks or cash are accepted.


Not necessarily. 

1. You must have one of the qualifying medical conditions as indicated by current Florida guidelines. If you do not have a qualifying medical condition as determined by Dr. Kurz, you will receive a full refund. 

2. The State of Florida has the final say on the approval of your complete application. 

The recommendation regarding your eligibility by Dr. Kurz is just a part of the process. 


Yes. Currently, the State guidelines are that a patient must be recertified every 210 days (7 months) and the state requires you to physically meet with your recommending MMJ doctor. You may not begin renewing your card until 45 days before your card expires.  


However, your MMJ card issued by the State renews annually. This is the $75 State fee. 


The initial certification/recertification and the State license/card renewal are two separate requirements on two different timelines.

Yes, if they meet state eligibility requirements.  However, if a qualified patient is younger than 18 years of age, only a caregiver may purchase or administer medical marijuana for the qualified patient. Patients who are minors may not purchase marijuana.  


Unfortunately, no. Currently, no insurance providers, Medicare nor Medicaid covers the initial certification, recertification, or the State license fee.

For Renewals, YES! As of July 1, 2023, the state of Florida now allows for Renewal visits to be conducted via Telehealth. Initial and Transfer visits must still be in person.


Absolutely! You will need access to the email address on file with your state account, as you will need to log in your state account to disconnect from your previous doctor. 

If you don't know how to do that, we can help you at your appointment but it will make things go faster for you if you either have access to that email address or you have disconnected from your previous doctor. (Log on, go to Your Profile, then click on Leave Your Current Physician.)
